Welcome to Gaali Do Punya Kamao (Curse for a Cause), universally known as GDPK (the "Platform"). This Platform is a proprietary digital venture owned, operated, and managed exclusively by WiserPivot Solutions, under the leadership of its Founder, Prathamesh Bhatte (hereinafter referred to as the "Company", "We", "Us", or "Our").
Please read these Terms and Conditions ("Terms") carefully before using the Platform. By accessing, browsing, or initiating a transaction on the Platform, you ("User", "You", or "Your", also collectively referred to as "GDPKers") explicitly agree to be legally bound by these Terms, our Privacy Policy, and all applicable laws and regulations of the Republic of India. If you do not agree to these Terms, you must immediately cease using this Platform.
1. Nature of the Platform and Service Scope
1.1. Satirical Digital Service: GDPK is an entertainment, satirical, and creative venting digital platform designed to provide users with a therapeutic medium to express frustration regarding systemic, corporate, infrastructural, or behavioral issues.
1.2. Platform Fee Model & Billing Merchant: The payment of ₹100 (Rupees One Hundred Only), or any such revised amount as determined by the Platform from time to time, is a standard Platform Interaction Fee charged or levied or updated dynamically for the utilization of our digital venting software, infrastructure, database maintenance, and broadcasting services. It is a commercial payment for digital services rendered and is not a direct charitable donation made by the User. Transactions on the Platform are processed securely by WiserPivot Solutions acting as the primary billing merchant.
1.3. Voluntary Corporate Social Responsibility (CSR) Allocation: WiserPivot Solutions independently and voluntarily commits to allocating a 70% share of its net transaction proceeds toward various independent social causes, charitable groups, or community initiatives (e.g., animal welfare, child welfare, elder care). The remaining 30% is retained by WiserPivot Solutions to fund platform operations, cloud database hosting, payment gateway processing charges, SMS/WhatsApp OTP delivery, administrative costs, and legal compliance fees.
1.4. How Often Funds Are Given: WiserPivot Solutions aims to send the collected cause funds to real NGOs and causes at least once every month. The exact date within the month may shift a little depending on real-world circumstances, but this is a genuine, ongoing commitment — not a one-time or occasional gesture.
1.5. Premium Tier & Recipient Preference: Users may optionally select a Premium contribution (₹750 or more, in ₹50 steps — set so that at least ₹500 actually reaches the cause allocation) and type the name of a preferred NGO, website, or recipient. WiserPivot Solutions will make genuine efforts to direct that portion of Curse Money toward the specified preference where reasonably practicable. This is a preference only, not a binding instruction — final recipient selection remains at the sole discretion of WiserPivot Solutions, based on legitimacy verification and real-world operational considerations. No guarantee is made that funds will reach the specifically named recipient, and no refund will be issued on this basis, consistent with Section 4.
2. Legal Status as an Intermediary (Safe Harbor Protection)
2.1. Section 79 Compliance: The Platform functions strictly as an "Intermediary" as defined under Section 79 of the Information Technology Act, 2000, and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules.
2.2. No Pre-Modulation or Endorsement: The Company does not author, pre-screen, verify, or endorse the factual accuracy, truthfulness, or nature of the expressions typed by Users into any free-text field on the Platform, including but not limited to "The Receiver," "Location of the Receiver," "The Curse" (vent text), "Targeted Cause," and any custom, user-typed entries submitted via the "Add your own" feeling or situation fields.
2.3. Absolute Liability Shift: The User holds absolute, sole, and unshared civil and criminal liability for the text, titles, targets, and locations they submit. WiserPivot Solutions, its founder Prathamesh Bhatte, and its employees are completely indemnified against any legal disputes, defamation lawsuits, claims, or damages arising out of any user-generated text broadcasted on the Platform.
3. Strict Prohibitions and Content Guidelines
To maintain public decency, adhere to banking partner mandates, and guard against targeted personal harassment, GDPKers must operate under strict, absolute guardrails.
The following restrictions apply to all free-text fields on the Platform, including the Receiver, Location, Vent, Targeted Cause, and any custom "Add your own" emotion or situation entries. You explicitly agree that you will not post content that:
3.1. Identifies Private Citizens: Contains full personal names, residential addresses, private telephone numbers, private email IDs, Aadhaar numbers, or any specific identifiable personal information of private individuals. Venting must remain restricted to public bodies/organizations (e.g., MSEB), corporate brands, broad operational titles (e.g., "My Boss", "The Marketing Manager"), or general behaviors (e.g., "Litterbugs at Kothrud"). Mentioning public organizations, corporate entities, or government units by name is permitted solely for contextual, localized relatability, provided it does not identify a specific private citizen.
3.2. Violates Public Decency or Laws: Contains explicit obscenity, severe vulgar profanity, hate speech targeting any protected class, communal or religious slurs, threats of physical violence, or material that harms national security or public order.
3.3. Pre-Payment Content Screening: Before any payment is processed, the Company runs automated screening on your submitted text across all free-text fields, checking for the categories described in Sections 3.1 and 3.2 — personal identifiers (phone numbers, email addresses), hate speech or targeted slurs, and threats of physical violence. If a submission is flagged, it is rejected before any payment is taken; you will see a specific reason and may edit and resubmit. No payment is ever charged for a rejected submission, and no content is automatically altered, masked, or published in modified form — a submission either passes exactly as written, or is not accepted at all.
4. Absolute No-Refund Policy
4.1. Finality of Transaction: All transactions executed on the Platform are final. Once the payment gateway processes the Platform Interaction Fee (whether ₹100 or any revised future amount) and issues a successful confirmation, no refunds will be granted under any circumstances.
4.2. No Refunds for Rejected Submissions or Post-Publication Removal: (a) If your submission is rejected by our pre-payment content screening (Section 3.3), no payment is taken in the first place, so there is nothing to refund. (b) If a post that has already been published and paid for is later hidden, disabled, or removed — whether due to a legitimate third-party take-down request (Section 6) or a violation identified after publication — you will not be entitled to any refund for that payment. The fee is consumed entirely by the digital infrastructure processing the transaction and the submission already completed.
4.3. Technical Drops: If funds are deducted from your account due to a banking failure but do not reach the Platform's database, the refund will be handled entirely via the standard settlement cycles of your automated UPI/banking payment gateway provider, not by the Company.
4.4. Premium Recipient Preference: If a Premium contribution's specified NGO/recipient preference (see Section 1.5) cannot be fulfilled for any reason, this does not constitute grounds for a refund. The Platform Interaction Fee remains fully consumed by the service already rendered.
5. Tax Disclaimer and 80G Certificates
5.1. No Personal Tax Exemption: Because the transaction fee is a commercial payment made to the Company for platform usage and not a direct donation to a registered non-profit by the individual, Users are not entitled to receive tax deduction certificates under Section 80G of the Income Tax Act, 1961.
5.2. Estimated Distribution Transparency: The counters shown on the Platform's summary boards and your account dashboard reflect an estimated distribution ledger of the corporate funds independently channeled by the Company. This tracking is provided purely for operational transparency and moral fulfillment, carrying no direct individual tax benefit.
6. Grievance Redressal and Fast Take-Down Policy
6.1. Notice and Take-Down Mechanism: In strict compliance with the Intermediary Guidelines of the Information Technology Rules, any corporate entity, government branch, or individual who feels a specific post on the platform is defamatory, violates privacy, or infringes intellectual property may file a formal complaint.
6.2. Grievance Officer Details: All compliance complaints, legal notices, or inquiries must be directed to our designated Grievance Officer, Prathamesh Bhatte, exclusively via email at: wiserpivot.solutions@gmail.com (Mention 'Grievance' in the Subject).
6.3. Resolution Timeline: Upon receipt of a valid, verifiable notice containing the exact link/ID of the offending post and proof of harm/infringement, the Platform will take down or disable public access to the post within the legally mandated window of 24 to 36 hours. The User who posted the content agrees that they have no right to contest this administrative removal.
6.4. Requesting Removal of Your Own Submission: You may also ask us to remove a submission you made yourself, at any time, by emailing the Grievance Officer (Section 6.2) with the Phone Number used, the Receiver Name, and the Vent Text, so the entry can be located. Removal here means the entry is hidden everywhere it would otherwise appear, including in your own ledger — it is not a data deletion. The underlying record, including the payment made, is retained internally for accounting and legal purposes and remains non-refundable under Section 4.2.
6.5. NGO Reference List — No Association or Endorsement: Where the Platform displays a reference list of NGOs (organized by cause category, for informational purposes), this list is independently compiled and does not constitute or imply any official partnership, affiliation, sponsorship, or endorsement relationship between the Company and any NGO named. The same applies to any third-party verification tool referenced alongside it (including, without limitation, giveradar.com), with which the Company similarly has no association. Should a User choose to independently contact, verify, or donate to any NGO named in this reference list, that action is undertaken entirely at the User's own discretion and initiative; the Company is not a party to that separate transaction and accepts no responsibility, obligation, or liability arising from it.
7. Cyber-Attack, Automation, and Scraping Protections
7.1. No Automated Submissions: Users are strictly prohibited from using bots, scripts, spiders, scrapers, or any automated software to post curses, query the database, or scrape data from the homepage leaderboards.
7.2. Rate Limiting: The Company reserves the right to implement automated rate-limiting protocols (e.g., locking out an IP address or mobile number making excessive rapid hits) to maintain server health and protect platform scalability.
8. Dispute Resolution and Jurisdiction
8.1. Governing Law: These Terms and any operational issues or transactions arising out of the Platform shall be governed exclusively by, and construed strictly in accordance with, the laws of the Republic of India.
8.2. Jurisdiction: Any legal actions, suits, or proceedings arising out of or relating to this Platform shall be subject to the exclusive jurisdiction of the competent courts located in Pune, Maharashtra, India, where the executive and billing operations of this platform are monitored and handled.
9. Amendments to Terms
9.1. The Company reserves the absolute right to amend, alter, or update these Terms at any point without prior individual notice to the Users. Your continued use of the Platform following any changes implies your absolute acceptance of the updated terms.
